Represented a property owner in securing insurance approval for more than $500,000 in remedial work, demolition, and asbestos and lead abatement related to a former dry-cleaning facility in Green Bay. The matter involved preparing and presenting an insurance claim addressing the costs associated with demolishing a large structure to allow access for the removal of substantial contamination at the site. The property is located within an area experiencing renewed commercial development, and the completed work contributed to improved marketability of the site.
Client Success 2:
Obtained an insurance recovery of nearly $900,000 for environmental remediation costs and attorney’s fees related to a gasoline spill claim. The matter involved the use of forensic fingerprinting analysis to distinguish contamination associated with prior spills from a more recent spill covered under the insurance policy.
Negotiated a 65/35 allocation agreement under which the insurer accepted responsibility for 65% of the remediation costs connected to the recent spill, while the remaining 35% was attributed to an earlier spill covered through PECFA.
Client Success 3:
Represented a client in negotiating a remediation agreement with a national non-profit organization involving the redevelopment of a commercially valuable property affected by dry-cleaning solvent contamination. The purchaser sought cleanup measures exceeding applicable state standards and contributed $388,000 toward the removal of additional contamination. Following completion of the remediation work, the client moved forward with construction of a prominent retail location on the site.
