Corporate

Our corporate lawyers represent public and private companies, financial institutions, private investment funds, individual investors and other corporate stakeholders in a wide range of transactions, as well as related corporate governance, regulatory and operational concerns. We are leaders in the middle market, with significant experience advising on mergers, acquisitions and divestitures; joint ventures and private equity transactions; asset-based finance; commercial and institutional lending; debt and equity offerings; franchising, licensing and distribution; investment management and fund formation; restructurings and business divorces. Our corporate capabilities are enhanced by our strength in tax, bankruptcy and restructuring, ERISA and employment law.

Government Relations

Made up of a former four-term U.S. Congresswoman, and several former New York City and state officials and public servants, our government relations group delivers strategic political insights and advocacy. Whether you’re mobilizing support for legislation, lobbying for a bill’s passage or defeat, dealing with government procurement issues, or need assistance regarding government action or inaction – we are poised to help, and we have a long track record of success. In New York City, Albany and Washington D.C., our services include lobbying, ethics compliance, administrative law, government contracting and procurement, land use and zoning, government investigations, and international government and agent representation.

Intellectual Property

Our copyright, trademark, trial and transactional lawyers are seasoned in the protection of everything from brand names and original content to novel ideas and proprietary technology. We feature a robust copyright and trademark practice focused on clearing, registering, maintaining and assigning copyrights and trademarks in the U.S. and abroad. We also have extensive experience licensing brands, content and publicity rights across a broad sector of the economy; and litigating copyright, trademark, licensing and other IP disputes in state and federal courts. We also advise on corporate transactions involving IP assets, including joint ventures, strategic alliances and IP asset acquisitions.

Litigation

We are experienced trial lawyers with an established track record of successfully defending, prosecuting and resolving trial and appellate matters in state and federal courts, and major arbitration forums. Our team includes former in-house counsel of public companies, federal and New York State prosecutors, SEC trial and enforcement lawyers, and a former Kings County (Brooklyn) District Attorney. Our areas of practice are broad, and include class actions and multi-district litigation, business and employment litigation; IP litigation, product liability disputes; real estate and title insurance litigation, securities litigation and white-collar defense.

Private Clients

High-net-worth individuals and families rely on Herrick for astute tax and personal planning advice, trust and estate administration, and family business management and succession planning advice. Our lawyers will help you make the most of the legacy you've built, and plan for your family's financial future. Our litigators also regularly handle Surrogate’s Court litigation, including will contests, will construction and other legal disputes involving estates, trusts and taxes.

Real Estate

For over 90 years, we have been an ingrained part of the commercial real estate industry across the U.S. Our clients include high-profile owners, developers, lenders, funds, investors and other entities, who rely on us for acquisitions and dispositions, financings, development and construction, leasing, tax, litigation and many other areas. In addition, our Land Use & Zoning and Government Relations Groups have a strong track record of helping clients manage complex development matters and approvals such as zoning changes, special permits, variances, development rights transfers and matters involving historic and landmark preservation issues.

Restructuring & Bankruptcy

Herrick represents a broad range of creditor and debtors in all aspects of the workout, restructuring, reorganization and bankruptcy arenas. Ranked in the top tier in the New York City area by U.S. News and World Report, we advise all of the major players in the workout and bankruptcy process – including debtors and creditors, creditors' committees, trustees, receivers, financial institutions, funds, asset purchasers and claims traders, insurance companies, pension funds, landlords, and equipment lessors and licensors.

Sports Law

For more than five decades, our lawyers have helped franchises, owners, investors, leagues, broadcasters and other stakeholders shape the evolving sports landscape. We regularly advise on the purchase, sale, formation and operation of professional leagues and teams; joint ventures; stadium financings, development and naming rights matters; sponsorships and media rights transactions and other high-stakes concerns. Our lawyers also counsel executives and athletes in their outside investment activities, as well as in their tax and personal planning concerns.

Tax

We advise on a broad range of tax concerns impacting domestic and international clients doing business in the U.S., and U.S. clients operating and investing abroad. Strategic solutions, risk reduction and minimizing tax controversy are integral parts of our value-added approach for clients in many industries, including banks, insurance companies, investment funds, family offices, high-net-worth-individuals; and commercial real estate owners, developers and investors.
