Year called to the bar [Ontario]: 1977. Extensive peer-recognized experience since 1983 in the railway sector as counsel, advisor and advocate. Served as General Counsel (Ontario) for CN. Rejoined private practice in January, 1998. Since then Ken’s advocacy & counsel has continued especially in transportation law; dispute resolution in injury, commercial and shipping cases; and railway regulatory & rights of way issues. Has addressed aboriginal law issues & claims, surrender & treaty rights & consultation issues (in relation to both railway and non-railway operations and lands). Assisted clients with employment disputes, labour injunctions, inquests, or grievance dispute resolution. Expertise in drafting and interpreting commercial agreements in the rail sector, and in dealing with rail operators and industry representatives, & with federal & provincial regulatory agencies in the transportation, labour and employment, health and safety, and human rights fields. Has appeared in various arbitration & mediation proceedings, and in all levels of the courts - including in the Supreme Court of Canada and in the Court of Appeal for Ontario. Trained for Transportation Law Association ADR roster. Sole practice since January, 2009. Available for teamwork.
