Commercial Litigation · Defend national car rental company in action by former vendor seeking over $1 million in compensatory damages, plus punitive damages and attorneys’ fees, arising from claims for defamation per se and violations of the Illinois Consumer Fraud Act and the Illinois Unfair and Deceptive Trade Practices Act. Following extensive motion practice, obtain dismissal of defamation claim and secured favorable settlement prior to discovery through court-directed mediation. · Secured favorable high six-figure settlement in complex breach of contract and business tort dispute on behalf of minority vendor against public corporation following extensive mediation proceedings. · Obtained over $300,000 pre-hearing settlement of breach of contract, negligence and unjust enrichment claim arising from substantial property damage requiring environmental remediation following dispositive motions and mediation. · Represent government entity in declaratory judgment and unjust enrichment action against large public company seeking over $2,000,000 in damages. · Obtained dismissal of complaint against utility company alleging fraud, violations of consumer fraud act, and breach of contract. · Represent shareholder and former director in breach of fiduciary duty, fraud and indemnification actions. Develop and draft successful appellate briefs to uphold summary judgment in favor of the former director on breach of fiduciary duty and fraud claims seeking over $50 million in damages. · Prosecute indemnification action on behalf of prevailing former director; successfully obtain summary judgment and secured order awarding over $1.3 million in fees and expenses, including attorneys’ fees incurred in prosecuting the indemnification action. · Represent shareholder of closely held real estate development corporation in action seeking involuntary dissolution. Successfully oppose motions to dismiss and for summary judgment; on the eve of trial, successfully achieved involuntary dissolution via court-ordered auction between the two shareholders, in which the client received over $15 million for his interests. · Defend commercial real estate development company in action brought by competitor challenging negotiations with potential tenants and seeking over $60 million; secure dismissal of tortious interference with contract claim as time barred.
